What is the Offer?

• Flat INR 200 Paytm Cashback Offer will be available on Flipkart Platform on transactions made via Paytm Postpaid. The transaction must be for a minimum value of INR 2000 on a select range of products across categories.
• Offer is valid once per Paytm Account during the Offer Period.

What is the “Offer Period”?

• Offer will be valid from 23rd September 2022 (00:00 Hours) till 30th September 2022 (23:59 Hours).
• For Flipkart Plus Users, Offer will be valid from 22nd September 2022 (00:00 Hours) till 30th September 2022 (23:59 Hours).

How do I check if the product is eligible for the Offer?

• Offer is applicable on select products on all categories on the Flipkart Platform and except any product which should not be incentivized as per Government regulation.
• Offer will also be listed on the eligible product page, please check the product page before making the purchase.

What are key offer terms?

• Paytm and Flipkart reserve the right, at any time, without prior notice and without assigning any reason whatsoever, to add/alter/modify/change or vary these terms and conditions or to replace, wholly or in part, this Offer by another Offer, whether similar to this Offer or not, or to extend or withdraw it altogether.
• Cashback will be credited by Paytm in Paytm Wallet within 30 days from the date when the offer ends.
• If the Customer cancels the order, refund amount will be credited back to source and the Cashback amount would be adjusted against the order value during the Refund.[LR1]
• If an order is cancelled, the Offer may take up to 24 hours to refresh for the customer to utilise it again.
• If the user has not completed the KYC, or has breached their monthly wallet limit, instead of Cashback in their Paytm Wallet, they will receive Cashback in their linked bank account.

How and when will I receive the cashback?

Redemption Process:

• Login to Flipkart.com (Mobile App/Mobile Site/Website).
• Add eligible products to the cart.
• Proceed to checkout.
• Select Paytm Postpaid option on Payments Page.
• Complete your transaction using your Paytm Postpaid.
• Eligible users will receive a scratch card worth INR 200 that can be redeemed in the Cashback and Offers section in the Paytm Platform.
• Cashback will be credited in the Customer’s Paytm wallet within 30 days from the date when the offer ends.
• If the user has not completed the KYC, or has breached their monthly wallet limit, instead of Cashback in their Wallet, they will receive cashback in their linked bank account.

Where should I contact in case I didn't receive the cashback in Paytm wallet?

• If eligible for Cashback as per the order summary page, you should contact “Paytm Customer Care” from the help section on Paytm Platform.

What if I cancel or return the Order?

• If the Customer cancels the order, refund amount will be credited back to source and the Cashback amount would be adjusted against the order value during the Refund. However, Offer may take upto 24 hours to refresh for the customer to utilise it again.

Is there a limit on the number of transactions?

• Offer is valid once per Paytm Account during the Offer Period.

Preliminary

• This offer (“Offer”) is fully sponsored by Paytm on www.flipkart.com, Flipkart mobile app and Flipkart mobile site (collectively Flipkart Platform), which is owned and operated by Flipkart Internet Private Limited (Flipkart, We or Our). It is open to all residents of India holding a valid Paytm Account on “Paytm Platform” with at least minimum KYC done. If the user has not completed the KYC, or has breached their monthly Wallet limit, instead of Cashback in their wallet, they will receive Cashback in their linked bank account.
• By participating in the Offer (defined below), users agree to be bound by:
• These terms and conditions (T&C);
• The Terms of Use, Privacy Policy and other relevant documentation including any modifications, alterations or updates thereof, that are published on the Flipkart Platform; and
• All applicable terms and conditions on Paytm Platform.

Offer Details

• To participate in the Offer, you must do/ fulfill the following:
• Age must be 18 years or above;
• Must have a valid registered account on the Flipkart Platform and log into the same;
• Must have a valid Paytm Wallet
• Purchase of an eligible product
• The offer is applicable on products across all categories on the platform and except any product which should not be incentivized as per Government Regulation.
• The Offer is applicable on only using Paytm Postpaid Facility and not applicable on UPI/ wallet/ credit/debit card options available with Paytm.
• If the Customer cancels the order, refund amount will be credited back to source and the Cashback amount would be adjusted against the order value during the Refund.
• If an order is cancelled, the Offer may take upto 24 hours to refresh for the Customer to utilise it again.
• This offer is only applicable on a select range of products across categories.

Other Terms and Conditions

• This Offer is valid only in India.
• This Offer is open to only end consumers and not the resellers of the products.
• This Offer is only applicable on transactions made through Paytm Postpaid as payment option.
• The Offer is not applicable for cash-on-delivery transactions or orders converted from Cash On Delivery to Prepaid.
• Flipkart shall not be responsible for any loss, injury or any other liability arising due to participation by any person in this offer.
• Paytm/Flipkart reserves the right to disqualify the User(s) from the benefits of the Offer, if any fraudulent activity is identified as being carried out for availing the benefits under the said Offer or otherwise by use of the account.
• Any person availing this Offer shall be deemed to have accepted these terms and conditions.
• Paytm and Flipkart reserve the right, at any time, without prior notice and without assigning any reason whatsoever, to add/alter/modify/change or vary these terms and conditions or to replace, wholly or in part, this Offer by another offer, whether similar to this Offer or not, or to extend or withdraw it altogether.
• Users are not bound in any way to participate in this Offer. Any participation is voluntary, and the Offer is being made purely on a best effort basis.
• Nothing herein amounts to a commitment by Paytm/Flipkart to conduct further, similar or other Offers.
• The above Offer is by way of a Special Offer for Paytm Wallet users only and nothing contained herein shall prejudice or affect the terms and conditions of the Paytm User agreement. The terms of the above schemes Offer(s), shall be in addition to and not in derogation of the terms contained in the Paytm User Agreement.
• You, the User, understands that Flipkart may share your transactional data/informationwith Paytm for purposes of this Offer and for checking your eligibility for their products and services and by participating in this Offer, you consent to this sharing of your data for these purposes.
• Any query regarding the program will be entertained till 30 days of purchase date. Post such date, Paytm and Flipkart will not entertain any correspondence or communication regarding this Program from any persons/Customer.
• Paytm/Flipkart do not endorse any of the products or brands being offered under the Program and will not accept any liability pertaining to the quality, merchantability, fitness, delivery or after sales service of such products which shall be at the sole liability to sellers on the Platform.
• Pictures of products shown in the communication sent to the Customer either through mailers or advertised on the website, are representative only and may not bear a resemblance to the actual products. None of the Parties shall under any circumstances be responsible towards the same.
• Products offered under this program are subject to availability from the respective participating merchants/sellers on the Platform and accordingly Paytm or Flipkart in no circumstances shall be liable for non-availability of any of the products.
• Under no circumstance will the Offer/Cashback being offered under this Program be settled with cash in lieu by Paytm or by Flipkart.
• Returned transactions, disputed or unauthorised/ fraudulent transactions will not be considered for the Offer.
• Paytm and Flipkart will not entertain any correspondence regarding the validity or acceptability of any additional benefits offered by seller(s) on products/services made available by it and the same shall be at the sole risk and consequences of such seller(s) and without reference to Paytm & Flipkart.
• Flipkart shall not be liable for any failure by Paytm to honour transaction and for any technical issues attributable to Paytm because of which the transaction made by the Paytm Wallet User was not successful. Parties shall mutually resolve the issues
• By participating in this Offer you the User agree to be bound by these terms and conditions of the Offer, standard terms and conditions, terms of use, privacy policy (as amended from time to time) of the Flipkart Platform and the terms and conditions of respective sellers shall be applicable on the User.
• Flipkart shall not be responsible for the fulfilment of this Offer, which shall be the sole responsibility and liability of the respective Seller. Customer understands that this Offer and other offers are provided by Seller(s) on the Flipkart platform and Flipkart shall not be liable towards the quality of the Product and/or fulfilment of the Offer and/or warranty claims and/or after sales services of the Product(s) and/or taxes arising out of the same. Any claim or dispute in relation to the same must be directed towards Seller only.
• This Offer is neither created/owned nor sponsored by Flipkart. Flipkart shall not be responsible if this Offer is in violation with any applicable law.
• This T&C shall be governed in accordance with the applicable laws in India. Courts at Bangalore shall have the exclusive jurisdiction to settle any dispute that may arise under this T&C.
• The User shall indemnify and hold Flipkart, Paytm and/ or seller(s) harmless against all damages, liabilities, costs, expenses, claims, suits and proceedings (including reasonable attorneys fee) that may be suffered by Flipkart, Paytm and/ or seller as a consequence of (i) violation of these terms and conditions, of the terms of user agreement, privacy policy (subject to change) published on the Platform, by user; (ii) violation of applicable laws by user; and (iii) any action or inaction resulting in willful misconduct or negligence on the part of the user.
• All government Levies like Sales Tax, TDS, any Local Tax, Octroi etc., shall be payable by the User as applicable at the time of the respective Offer.
• Customer acknowledges and confirms that You are aware of the nature of telecommunications/ internet services and that an email transmission may not be received properly and may be read or be known to any unauthorized persons. You agree to assume and bear all the risks involved in respect of such errors and misunderstanding and Flipkart shall not be responsible in any manner.
• This Offer shall be subject to all applicable laws, rules and regulations which are in existence, and which may be promulgated anytime by any statutory authority.
• Further, as required by applicable law, in the event that the user makes a purchase of an amount equal to or above Rs. 2,00,000, the user will be required to upload a scanned copy of his/her PAN account on the Platform, within 4 days of making the purchase, failing which, the purchase made by the User will be cancelled. The requirement to submit the PAN account arises only once and if it has been submitted once by the user, it need not be submitted again. The order of the user will be cancelled if there is a discrepancy between the name of the user and the name on the PAN account.
• This document is an electronic record in terms of Information Technology Act, 2000, and the Rules thereunder as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.
