Flipkart Advanz Private Limited (hereinafter referred to as "FAPL/ we/ our/ us") recognizes the importance of privacy, confidentiality and security of your personal data and values the trust you place in us.

Flipkart Advanz Services is a proposition enabled by Flipkart Advanz Private Limited (" FAPL ") on specified e-commerce or other platforms, and their related mobile sites and mobile applications (" Platform"), under which FAPL facilitates the granting of a loan by certain lending partner(s) (" Lending Partners ") to selected customers of the respective Platform (" You ") in accordance with the terms of Flipkart EM being made available by such Lending Partners to You (" Flipkart Advanz Services "). This Privacy Statement explains how we handle, treat, protect and otherwise process your personal data provided to us on Platforms “Platform” and how we use that information in connection with the services or products offered by us.

This Privacy Statement is published in accordance with the applicable data privacy laws of India

By visiting Platform, providing your information or using our service or product, you expressly agree to be bound by this Privacy Statement. This Privacy Statement is incorporated into and subject to the FAPL Terms and Conditions, the applicable FAPL product or service Terms of Use, and any relevant documentation or terms on the Platform.

Collection of Personal Data and other information:

When you visit Platform or use our products or services, we may collect your personal data which is provided by you from time to time including but not limited to your:

• name,
• work details (salary and company name),
• e-mail address,
• date of birth,
• gender,
• contact number/mobile number,
• device information,
• IP address
• PAN,
• credit score, credit information report, payment information, financial information, which may be shared/ uploaded by you, as and when you avail any products and/or services of FAPL and/or through FAPL’s partner platforms which FAPL may become privy to.

FAPL does not knowingly solicit or collect personal data from children under the age of 18 years. Use of Platform and products are available only for persons capable of forming a legally binding contract under the Indian Contract Act, 1872. If you are providing any information of a minor under the age of 18 years, you represent that you have the authority or legally authorized to do so and permit us to use such information in accordance with this Privacy Statement.

We may track certain information about you based upon your preference and the transactions you carry out on Platform, your participation in any promotions sponsored by us, correspondence that you send us through the Platform or any other medium, calls that we make to you or you make to us and surveys that you complete through the Platform or based on our request. We also access details of your visits to Platform including but not limited to IP address, domain server, type of computer used for accessing Platform, browser type, referring/ exit pages and URLs, number of clicks, domain names, landing pages, pages viewed, and other such information. We use this information to do internal research on our users' demographics, interests, and behaviour to better understand, protect and serve our users and to provide customized financial products to our users given individual interests, needs and requirements. This information is compiled and analysed on an aggregated basis.

We use data collection devices such as "cookies" on certain pages of Platform to help analyse our web page flow, measure promotional effectiveness, and promote trust and safety. "Cookies" are small files placed on your hard drive that assist us in providing our services. We offer certain features that are only available through the use of a "cookie". We also use cookies to allow you to enter your password less frequently during a session. Cookies can also help us provide information that is targeted to your interests. Most cookies are "session cookies," meaning that they are automatically deleted from your hard drive at the end of a session. You are always free to decline our cookies if your browser permits, although in that case you may not be able to use certain features on the Platform and you may be required to re-enter your password more frequently during a session. No personal data will be obtained through cookies and other tracking technology; however, cookies can be connected to the personal data that you may have previously shared with FAPL. Additionally, you may encounter "cookies" or other similar devices on certain pages of Platform that are placed by third parties. We do not control the use of cookies by such third parties.

If you choose to post messages on our message boards, chat rooms or other message areas or leave feedback on Platform, we will collect that information you provide to us. We retain this information as necessary to resolve disputes, provide customer support and troubleshoot problems as permitted by law.

If you send us or our partners personal correspondence, such as emails or letters, or if other users or third parties send us correspondence about your activities or postings on the Platform, we may collect such information into a file specific to you.

FAPL shall in no manner be responsible for the accuracy of the personal data or other information shared by you to FAPL or to any third party. If you provide any information that is false, inaccurate, non-current or incomplete (or is erroneous, wrong, non-current or incomplete), or whether FAPL has fair grounds to believe whether such details is false, wrong, non-current or incomplete, FAPL shall reserve the right to suspend or terminate your account at its sole and absolute discretion.

Use of Your Personal Data:

We use your personal data to provide, manage, develop and improve the products and services you request from us. These purposes include:

• registering/sourcing services to you on Platform and facilitate transaction including providing assistance to completion of online Flipkart EMIform;
• sharing with our affiliates, business partners and other third parties for the purpose of providing you products and services, including but not limited to financial institutions, credit information companies, for the purpose of underwriting and approval of loan ' transactions/related transactions, or for doing a check of your credit profile on your behalf;
• undertaking KYC due diligence, credit assessment and checking your eligibility for the financial products offered on our Platform (including financial and identity checks);
• Periodic assessment of creditworthiness via Bureaus and other financial institutions;
• providing you a safe, efficient, smooth, enhance customer experience, fulfill services; availed on Platform including carrying out your instructions to make and receive payments;
• enforcing, investigating, resolve disputes; troubleshoot problems; help promote a safe service; collect money;
• measuring consumer interest in our products and services, inform you about online and offline offers, products, services, and updates;
• reporting on financial / regulatory / policy and developing and retaining different types of risk management strategies;
• customizing and enhancing your experience; detecting and protecting us against error, fraud and other criminal activity;
• displaying tailored financial product offers to you and enable you to apply for certain products and services for which you have chosen to apply;
• sending you offers based on your previous orders and your interests;
• enforcing our terms and conditions;
• sharing with you, updates, information on products/service improvements along with their terms and conditions;
• facilitating promotion, marketing, web analytics, and advertising activities (to the extent we use your personal data to market our products and services to you, we will provide you the ability to opt-out of such uses);
• complying with financial services regulations including retention of financial information and transactions;
• improving our internal customer training;
• allowing you to participate in the interactive features of Platform;
• checking your eligibility for certain products/services including but not limited to credit and payment products and provide you access to the services being offered by us, our affiliates or lending partners;
• analyzing demographic and profile data about our users' activity on Platform;
• diagnosing problems with our server, and to administer Platform; or
• conducting online surveys.

Sharing of Personal Data:

We may share or disclose your personal data with our other corporate entities, affiliates, lending partners, technology partners, or business partners (such as UPI platform) merchants and other third parties (credit bureau, recovery teams). This disclosure may be required for us to provide you access to our products and services,, use of Platform, for checking your eligibility for the products and services offered on Platform, for enhancing your experience, to comply with our legal obligations, to enforce our agreement(s) with you, to facilitate our marketing and advertising activities, to prevent, detect, mitigate, and investigate fraudulent or illegal activities related to our services, for providing credit defaults and credit information, for communicating with you, for enhancing your pre-qualified loan offer if applicable, to authenticate your KYC information with the relevant authorities such as NSDL, UIDAI, CKYCR and also to register you for the products or services that you would be opting for.

We may disclose personal data if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to respond to subpoenas, court orders, or other legal process. We may disclose personal data to law enforcement offices, third party rights owners, or others in the good faith belief that such disclosure is reasonably necessary to: enforce our Terms or Privacy Statement; respond to claims that an advertisement, posting or other content violates the rights of a third party; or protect the rights, property or personal safety of our users or the general public.

We and our affiliates will share some or all of your personal data with another business entity should we (or our assets) plan to merge with, or be acquired by that business entity, or re-organization, amalgamation, restructuring of business. Should such a transaction occur that other business entity (or the new combined entity) will be required to follow this Privacy Statement with respect to your personal data.

Credit information report:

Your credit information (credit score and credit information report) is procured through a 'soft search' of your credit records with Credit Information Companies ("CIC") and FAPL has no control over the content or accuracy of information provided in your credit information by CIC. FAPL gets this information from CIC for and on your behalf only when you agree to appoint FAPL as your lawfully appointed authorized agent/ representative for collecting your credit information from CIC. By consenting to use and avail your credit information report through FAPL, you agree that FAPL and CIC shall be entitled to rely on your authorization and consent granted by you to FAPL.

Availing your credit information through FAPL is subject to your passing of appropriate identity authentication for security and privacy purposes. FAPL shall not notify you of the reasons if you are unable to pass such identity authentications and not able to view and/or use your credit information.

Links to Other Sites:

Platform links to other websites that may collect personal information about you. FAPL is not responsible for the privacy practices or the content of those linked websites and you are requested to carefully read the other websites or apps privacy policy when visiting such websites.

Security Precautions:

FAPL adopts reasonable security practices and procedures to protect from unauthorized access, damage, use, modification, disclosure or impairment of the information under our control. Whenever you change or access your account information, we offer the use of a secure server. Once your information is in our possession, we adhere to such reasonable security practices and procedures, protecting it against unauthorized access. In using the Platform, the users accept the inherent security implications of data transmission over the internet and the World Wide Web cannot always be guaranteed as completely secure. The location of servers where your data is being stored lies within India. In case of any data breach, FAPL shall take necessary steps as laid out by the concerned law enforcement agencies in India. You are responsible for ensuring the protection of login and password records for your account. You are also responsible for all uses of your account and password, whether authorized by you or not. You shall inform FAPL promptly of any true or alleged improper use of your account or password.

Choice/Opt-Out:

We provide all users with the opportunity to opt-out of receiving non-essential (promotional, marketing-related) communications from us on behalf of our partners, and from us in general, after setting up an account. If you want to remove your contact information from all FAPL lists and newsletters, please choose the unsubscribe option provided in the mailers that you receive from us.

Advertisements:

We may use third-party advertising companies to serve ads when you visit the Platform. These companies may use information (not including your name, address, email address, or telephone number) about your visits to this and other websites in order to provide advertisements about goods and services of interest to you.

Data Retention:

We retain your personal data in accordance with applicable laws, for a period no longer than that is required for the purposes for which it was collected or as required under any applicable law and in consonance with our record retention policy. However, we may retain data related to you if we believe it may be necessary for providing services, prevent fraud or future abuse, to enable FAPL to exercise its legal rights and/or defend against legal claims, or if required by law, or for other legitimate purposes. We may continue to retain your data in anonymised form for analytical and research purposes.

Data Deletion:

You understand that we will permanently delete all data and have no access to use any data received from you upon receiving the request from you to delete your data or revoke consent to use the data. You can reach out to customer support through helpcenter on Flipkart App for requesting the deletion of your data or revocation of consent to use your data. In the event that you withdraw your consent or request to delete your data given to us under this Privacy Policy, we reserve the right to restrict or deny the provision of our services for which we consider such information to be necessary.

Your Rights

We take every reasonable step to ensure that your personal data that we process is accurate and, where necessary, kept up to date, and any of your personal data that we process that you inform us is inaccurate (having regard to the purposes for which they are processed) is erased or rectified.

You have an option to withdraw your consent that you have already provided by writing to us at privacy.grievance@flipkart.com to assist you with any queries. Please mention “for withdrawal of consent” in the subject line of your communication. We will verify such requests before acting upon your request. In the event you withdraw consent given to us under this Privacy Statement, such withdrawal may hamper your access to the Platform or restrict provision of our services to you for which we consider that information to be necessary. Please note, that withdrawal of consent will not be retroactive and will be in accordance with the terms of this Privacy Statement, related Terms of Use and applicable laws. However, such withdrawal shall not affect the legality of processing of the personal data based on consent before its withdrawal including retention of data as required under the applicable law including guidelines or regulations mandating data retention issued by various regulatory bodies in India.

Consent:

By visiting Platform, providing your information or using our service or product, you consent to the collection, use, disclosure and otherwise processing of your information in accordance with this Privacy Statement. If you disclose any personal data relating to other people to us, you represent that you have the authority to do so and to permit us to use the information in accordance with this Privacy Statement.

You authorize and expressly consent us to share your personal data with third parties including but not limited to lending partners, Credit Information Companies, Telecom Service Provider, NSDL, UIDAI, DigiLocker to do an aggregate check of your credit profile, carry out background check and to verify the court records for FAPL products and services.

You, while providing your personal data over the Platform, expressly consent to FAPL (including its other corporate entities and affiliates, lending partners, technology partners and other third party entities, marketing channels and business partners) to contact you through SMS, instant messaging apps, call and/ or e-mail.

By choosing to avail Flipkart EMI offered by the lending partners through FAPL, you agree to the terms and conditions, privacy policy and any other product terms extender by the lending partners. Please read the terms and conditions carefully before availing Flipkart EMI.

You have the right to withdraw your consent that you have already provided in accordance with the terms of this Privacy Statement and the applicable terms of use, but please note that withdrawal of consent will not be retroactive. In the event that you withdraw consent given to us under this Privacy Statement, we reserve the right to restrict or deny the provision of our services for which we consider such information to be necessary.

Changes to the Privacy Statement

We are constantly trying to improve our websites, applications, services and products, so we may need to change this Privacy Statement from time to time as well. You are responsible for periodically reviewing this Privacy Statement. We may however endeavor to notify you of any material changes by, for example, placing a notice on Platform and/or by sending you an email, when we are required to do so by applicable law. Your continued use of our services will be considered as your acceptance and agreement to the revised policy.
