Lenovo Accidental Damage Protection - 1 Year
The Plan
This Protection Plan is sold by Servify (Service Lee Technologies Pvt. Ltd.) on behalf of Lenovo (India) Private Limited (“Lenovo”) and fulfilled by Lenovo for Headphones / Earphones, Soundbar, Speakers / Portable Speakers (“Device”) sold by Lenovo through Flipkart in India on the “Flipkart Platform”(i,e www.flipkart.com, Flipkart mobile app, Flipkart lite platform)& in its original packaging. This plan is not valid for any devices that are either refurbished or purchased by a customer post a return from the first customer, even in unboxed condition.
Plan feature
· Get the peace of mind and coverage for repairs with the convenience of in-home service. No hidden
fees, you won't pay a rupee in deductibles and fees for service.
· Support Beyond the Normal System Warranty by Providing Coverage for Damage Due To
Electrical Surge, Spills, Drops Or Bumps in basic office and home environment
Lenovo warrants that each Lenovo hardware device that you purchase is free from defects in materials
and workmanship under normal use during the plan period.
Plan Eligibility
· This Plan can be purchased only with the original purchase of the Device, and subject to the Device being in its perfect working condition.
· The Device is registered for the Plan benefits on completing the Plan purchase process. An automated Plan Activation Confirmation is sent on your registered email Id.
· The terms of this Plan, the original sales receipt for your Plan, the proof of your identity, the indemnification you provide about the working condition of the Device before the purchase of the Plan and the Plan Confirmation are each part of your Plan
Coverage
· The Plan period for the Device starts on the original date of purchase as shown on your sales receipt or invoice or as may be otherwise specified by Lenovo. This protection plan only applies to devices in the country or region of purchase.
· Lenovo Authorized protection against accidental drops, spills, bumps, and structural failures incurred under normal operating conditions or handling, including electrical surges and damage to the integrated LCD screen ( Home and Office environment only)
Inclusions
Types of Service
This Service covers operational or structural failure caused by:
· liquid spills on the keyboard;
· Unintentional bumps or drops from not more than fifteen (15) feet or five (5) meters; and
· An electrical surge that damages the product’s circuitry, or failure of the integrated screen, Lenovo will repair or replace (in its sole discretion) the product; provided, however, that the damage to the product is caused by an accident and is unintentional. This Service only covers components installed in your product at the time of purchase, including the internal central processing unit, integrated hard disk drive, integrated optical drive, integrated keyboard, integrated pointing devices, integrated screen, optional features installed by Lenovo at the time of purchase, and other components that Lenovo includes as a standard feature with the product.
Exclusions
ADP does not cover the following:
A. CRU batteries, light bulbs, memory disks, wire connections, AC adapters, carrying cases or folios, stylus or digitizer pens, cradles, docking stations, port replicators, external keyboards, printers, scanners, external drives, software (preloaded or purchased separately), tapes, CDs, DVDs, film or other media, external modems, external speakers, monitors, external mice or other input/output devices, projectors;
B. Any other components not internal to the product, any pre-existing defects in your product that occurred on or before the date of this Agreement, optional features not installed by Lenovo at the time of purchase, accessories purchased in addition to the base unit, third-party products (those not bearing the Lenovo logo) even if sold by Lenovo, products not purchased from Lenovo or any products repaired by anyone other than Lenovo or a service provider authorized by Lenovo; c) Normal wear and tear of the product;
C. Parts intended to be replaced or consumed - e.g., batteries, stylus, digitizer pen, etc,; or
D. Cosmetic damage (e.g., scratches, dents, or cracks that do not affect the product’s functionality or structural integrity);
· Damage from abuse, misuse, unauthorized modification, unsuitable physical or operating environments, improper maintenance by anyone other than Lenovo-authorized service providers, removal of original parts or alteration of product or identification labels;
· Damage caused by a product not covered under this Agreement or caused by biohazards or human or animal bodily fluids; or
· Theft, loss or damage from fire, flood, or natural disaster, war, terrorism, acts of God.
Special Exclusions
Servify and Lenovo shall not be liable in respect of loss or defect to Registered Device relating to or caused due to the following:
· Loss or defect due to any experiments or tests and/or alterations resulting to any abnormal conditions of the Registered Device
· Loss or defect due to mechanical or electrical break down or derangement, unless such loss is not accidental defect and which is covered within the Manufacturer’s Warranty during the Plan Term of the Manufacturer’s Warranty
· Penalties for delay or detention or in connection with guarantees of performance or efficiency
· Loss due to the Registered Device which gradually develops flaws, defects, cracks or partial fractures in any part not necessitating immediate stoppage, although at some future time repair or renewal of the parts affected may be necessary
· Loss due to deterioration or wearing away or wearing out of any part of the Registered Device that is caused due to or naturally resulting from its normal use or exposure
· Damaged device where the serial number cannot be identified.
Servify and Lenovo shall not be liable if:
· The Customer or User is found to be involved in any way in fraudulent or illegal activity of any kind whatsoever related to this Plan or Registered Device and/or the Plan is purchased for the Registered Device after 365 calendar days from the date of purchase of the Registered Device
· Due to the inability of the Customer to submit any of the repair request processing and Device purchase documents required by Servify or its partners for processing the eligible repair request
The Plan shall also not cover a loss:
· Repair Request amount has exhausted the Benefits Value of the Registered Device
· In any action, suit or other proceeding where Servify or its underwriting partner(s), alleges that by reason of the provisions of the exceptions or exclusions above, any loss, destruction, defect or liability is not covered by this Plan, the burden of proving that such loss, destruction, defect or liability is covered shall be upon the Customer
Plan Activation
· On purchase of Plan from Flipkart Web Portal, the Plan will be automatically activated subjected to validation of Device eligibility. The Customer will get an automated communication of activation of the Plan through an email.
Service Request Process
In the event of defect to the Registered Device, you (Customer) are required to:
· Immediately (not later than 72 Hours from the time of the defect) inform Lenovo support on Phone - 1800-419-7555, or email - consumerts@lenovo.com, detailing the defect, and any documentary evidence of the defect.
· Please note, you (Customer) will not handover the Registered Device for repairs at any service centre, including at any Lenovo Authorised Service Centre until confirmed by Lenovo. It is expressly stated that Lenovo will not be held responsible for fulfilling any such requests where the Registered Device is handed over to a service centre by you (Customer) before the approval from Lenovo; any liabilities arising out of such actions before the in-principal approval of the request from Lenovo will be solely handled by you at your own expense
Service Fulfilment Process
· Lenovo provides services through OnSite Service for the Registered Device, for serviceable locations.
· Under On-Site Service, a Service Provider will either repair or exchange the device at your location. You must provide a suitable working area to allow disassembly and reassembly of the device. Some repairs may need to be completed at a service center. If so, the Service Provider will send the device to the service center at its expense.
· Lenovo reserves the right to change the method by which they may provide repair service to you, and your Registered Device’s eligibility to receive a particular method of service under this Plan. Service options, parts availability and response times may vary according to the city you live in
Your Responsibilities
To receive service or support under the Plan, you agree to comply with the following:
· Provide a copy of your Registered Device’s original proof of purchase, if requested
· Provide information about the reasons and causes of the defect to the Registered Device
· Provide identity proof if requested to verify Customer or User of the Device on which Plan is activated
· Respond to requests for information, including but not limited to the serial number of the Registered Device, model, version of the operating system and software installed, any peripherals devices connected or installed on the Registered Device, any error messages displayed, actions taken before the Registered Device experienced the defect and steps taken to avoid the defect
· Follow instructions Lenovo or ASPs gives you, including but not limited to refraining from sending Registered Device that is not subject to service as per the Plan and packing the Registered Device in accordance with shipping instructions
· Make sure to backup software and data residing on the Registered Device. DURING THE FULFILLMENT OF SERVICE LENOVO OR THE ASP MAY DELETE THE CONTENTS OF THE COVERED DEVICE AND REFORMAT THE STORAGE MEDIA IF NECESSARY. Lenovo, or ASPs may return your Registered Device after the service event or provide a replacement unit as the Registered Device was originally configured, subject to applicable updates. Lenovo or the ASPs may install latest software updates as part of hardware service that may prevent the Registered Device from reverting to an earlier version of the Operating System. Third party applications installed on the Registered Device may not be compatible or work with the Registered Device as a result of the Operating System update. You will be responsible for reinstalling all other software programs, data and passwords
· Fill and submit the requested forms and the declaration as required for submitting a valid a repair request
General Terms :
· The after-sales tech support is carried out entirely owned by Lenovo. Hence, Servify & Flipkart are not liable for it.
· Any issues or customer experience arising out of claims and service fulfilment is sole responsibility of Lenovo.
· Servify is not obligated to renew this Plan. If either Servify does offer a renewal, they will determine the price and terms
· There is no informal dispute settlement process available under this Plan
· In the event any section or portion of a section of these terms and conditions are deemed invalid, void or unenforceable, that section or portion of a section shall be severed from these terms and conditions, and the remaining terms and conditions shall continue in full force and effect
· These terms and conditions shall be governed by and construed under the laws of India
· These terms and conditions do not affect your statutory rights as a consumer.
•The customer releases and holds harmless Flipkart and Servify, its agents, affiliates, and employees from and against any claims, damages, or liability of any kind, including personal injuries, death, or property damage, or any direct, indirect, consequential, incidental or other damages, which the Customer or anyone else may suffer as a result of participation in this Plan.
•The customer agrees that his contact details can be shared by Flipkart with Servify. Flipkart Order ID and contact details of the Customer will be shared by Flipkart with Servify for verification purposes. The usage of personal data is subject to Servify’s privacy policy and Flipkart's privacy policy here: http://www.flipkart.com/s/privacypolicy.
•Flipkart hereby excludes and disclaims all liabilities, whether direct or indirect, that may arise due to the Plan. The customer shall contact Servify for any disputes/issues related to the Plan and Flipkart shall not be held liable for any such disputes/issues. Further, the Customer agrees that for any defects regarding the Device, the Customer shall have a direct recourse against the seller of the device and Flipkart shall not be held liable.
Servify shall be solely responsible for fulfilling the terms of this Plan. Flipkart shall not be liable for any loss, injury or any other liability arising to the customers as a result of the Servify’s failure to honour its obligations with respect to the customer.
Flipkart shall not be liable for correctness, validity and completeness of any information provided by the customers. Flipkart shall not be responsible if any information has intentionally been withheld or incorrect information or misrepresentations have been intentionally given by the customers that are of significance to the assessment of the claim.
By entering into this Plan, the customer agree to indemnify and keep Flipkart harmless against all damages, liabilities, costs, expenses, claims, suits and proceedings (including reasonable attorney's fees) that may be suffered by Flipkart as a consequence of (i) violation of the terms of this Plan by the customer; (ii) violation of applicable laws; (iii) any action or inaction resulting in willful misconduct or negligence on the Customer's part.
Subject to the above, all the terms and conditions of the Plan as given hereof and standard terms and conditions, user agreement, privacy policy (subject to change) of www.flipkart.com shall be applicable on the Customer. In the case of any conflict between the terms and conditions contained herein and the terms and conditions, user agreement, terms of use and privacy policy of flipkart.com, the terms and conditions, user agreement, terms of use and privacy policy on flipkart.com shall prevail.
